1. Introduction

These Terms of Service ("Terms") govern your use of the SmallCloud platform and related services ("Services") provided by SmallCloud ("SmallCloud," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

2. Service Description

We provide a platform that provisions and manages online services for your business, including domain registration and DNS, website building and hosting, email, telephony, payment processing, file storage and breach monitoring. The services available to you depend on your subscription plan.

3. Acceptable Use

You agree to use our Services responsibly and legally. Prohibited activities include:

• Using the Services for any unlawful purpose
• Sending unsolicited communications
• Attempting to gain unauthorized access to our systems or other customers' data
• Distributing malicious code or conducting denial of service attacks
• Engaging in activities that may harm our Services' reputation or reliability
• Using the Services in ways that may trigger automated abuse prevention systems

We reserve the right to suspend or terminate services if we determine, in our sole discretion, that your use violates these Terms or poses a risk to our Services or other customers.

4. Customer Responsibilities

You are responsible for:

• Maintaining accurate account information
• Keeping access credentials secure
• Using the Services in compliance with applicable laws
• Ensuring your content and activities don't infringe on others' rights
• Maintaining appropriate security measures for your account and content

5. Service Availability

We strive to provide reliable services and will make reasonable efforts to maintain service availability. We will notify you of maintenance activities that may impact your service. Specific service levels may be defined in your subscription plan.

6. Data Management

We implement appropriate security measures to protect data processed through our Services. You are responsible for maintaining appropriate backups of your content unless backup services are explicitly included in your plan.

7. Fees and Payment

Services are billed according to your selected plan. All fees are non-refundable unless otherwise specified. We reserve the right to modify fees with advance notice.

8. Term and Termination

Either party may terminate these Terms with written notice. Upon termination:

• You must pay any outstanding fees
• We will securely delete your data after a reasonable period
• You are responsible for migrating your content

We may suspend or terminate services immediately if you violate these Terms.

9. Limitation of Liability

We provide Services "as is" without warranties of any kind. Our liability is limited to the amount paid for Services in the preceding month.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes. Your continued use of the Services constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by Canadian federal law and the provincial law of Quebec.
